Their work “debunked [Trump’s] claims of self-made wealth and revealed a business empire riddled with tax dodges,” according to the Pulitzer Prize board.

After the article’s publication, Trump dismissed the story as a “hit piece” that was “boring.”

Donald Trump’s suit alleges that the New York Times influenced Mary Trump to help them acquire confidential documents despite a settlement agreement that she had signed after a legal challenge to Fred Trump Sr.’s will. In her 2020 book “Too Much and Never Enough,” Mary Trump detailed how she helped the reporters obtain Donald Trump’s financial records.


At 3 a.m., she took 19 boxes of documents from Farrell Fritz, the law firm that helped her challenge the estate of Fred Trump Sr., and handed them over to the journalists. A lawyer at the firm had told her she was entitled to take the documents, as long as at least one copy was left behind, Mary Trump said.

“It wasn’t enough for me to volunteer at an organization helping Syrian refugees,” she wrote. “I had to take Donald down.”

News of the lawsuit was first reported by the Daily Beast. Mary Trump told the news website that the legal action was motivated by “desperation. … The walls are closing in and he is throwing anything against the wall that will stick. As is always the case with Donald, he’ll try and change the subject.”

A spokeswoman for the Times said that the paper’s coverage of Donald Trump’s taxes “helped inform citizens through meticulous reporting on a subject of overriding public interest. This lawsuit is an attempt to silence independent news organizations, and we plan to vigorously defend against it.”

Donald Trump and Mary Trump didn’t immediately return requests for comment.

So explain this to me like I'm a five-year-old non-lawyer.  I think that defamation cases are hard to prove because you have to prove that the defendants knowingly spread lies i.e. they KNEW what they were saying was false.  Doesn't this memo prove that Sidney Powell, Giuliani, Lin Wood, Jenna Ellis etc... KNEW that Dominion did nothing wrong and spread lies about Dominion anyway?  And, if so, aren't they screwed in Dominion's defamation lawsuit?

They don't have to "KNOW" that it's untrue, but acting with reckless disregard for the truth is sufficient if the plaintiff is a "public figure," which Dominion probably is.

I think there's a ton of evidence of reckless disregard, of which this is but a piece.  The "problem" with this evidence is that it isn't really conclusive or truth or falsity (it's just another "asshole in a lab" to borrow a phrase) and it's not necessarily known to/by the defamation defendants.

I have tons of knowledge concerning NDAs and confidentiality agreements in the context of trade secrets, but almost none outside that context.  There seems to be a sort of "crime/fraud" public policy exception that makes breach of such agreements essentially lawful, when the purpose is to expose wrongdoing, but I'm not sure how strong that is.

And, it seems ironic that the damages are probably based on the notion that her breach "exposed me as a criminal and a cheat," which is certainly unpleasant, but if it's true, where are the damages?

There are none. There never are.

The purpose of confidentiality agreements is to give the one who wants it a contractual basis to file suit to enforce it. It’s the threat of being sued that keeps people to that agreement. 
 

But once the lawsuit is filed for breach of confidentiality, 99.9 percent of the time they cannot prove damages. 
 

It’s just an intimidation tactic.

As if we didn't know already, she's fucking insane.

Also, apparently, her grievance from Michigan and others is proceeding and will have a hearing November 4.  Not clear to me which hearing this may be.

I really would like to know how in the hell trump can keep claiming the election was fixed when every indication says it was not, and the fkn press keeps airing his bullshit.  Is there some point at which these media clowns become liable to prosecution for spreading a blatant lie on the national networks?

I didn't clarify upthread, but Powell's Texas bar grievance hearing is November 4.  I believe that means that it has advanced beyond preliminary stages into the substance of it.

I won't comment additionally, but there is apparently no record of this lawsuit.  She is certifiable.
