They don't. Neither does the 4th.  But authoritarian courts love them some gutting of basic liberties.  So they functionally killed those (especially the 4th, seriously) years ago.  Shit, they killed it when they allowed searches based on this simple sentence: "Based on my years of experience and training as a peace officer, I recognized the distinctive smell of marijuana...."  It doesn't even have to be true.  A cop just has to SAY it, and that he BELIEVED he smelled weed, and that's enough.  He can search your person, your car, your house, whatever he wants.  All he has to do is start the probable cause affidavit with "I smelled what I thought was weed."

The problem these guys have is that they think the law should only buttfuck dirty mexicans, it shouldn't apply to good white folks like them.  More often than not, their assumption is correct.  This time, it wasn't....mostly because rec specs went right to belligerent cussing at the cop lady.

All they had to do was say they were American citizens, let them take a peek, and they would have been through the checkpoint a minute or two later.  We’ve went through those checkpoints a dozen times in the past ten years or so, and the only time we get any actual scrutiny is when any of our Hispanic in-laws are with us.  Even then it’s just an extra minute or two.

These were two white guys in a work truck.  They could have been through the checkpoint just as quickly as we get through them.

Near the end the driver mentions he is in a company vehicle. Given how quiet the driver was the whole time I’m assuming he is the younger brother and has been dealing with this kind of shit his entire life

Self ownage level is just shy of max, where max would be getting himself killed. That’s totally in the realm of possibility in this scenario. He aggressively goes for the glove or console, and they fill that cabin full of lead.

Yea that was one of my favorite parts.  You can tell that driver was thinking “Oh, fuck.  Not this shit again!”.

A simple "yes" when she asks if he's a citizen and they would have been on their way.  

And make sure you say "yes" in English.  When I was 16 some friends and I ventured into to Matamoros during spring break...on the way back in the officer asked if I was a citizen, and young, dumb Dixon decided to be funny and say "si".  Let's just say the cop got the last laugh...I've spoken crystal clear English when faced with the same situation since.

I had the opposite happen in Laredo. I was coming back over on a scooter, both lanes towards the USA packed, and a Mexican taxi driver wondered why I was waiting in line, on a scooter I should just cut around everybody.

So I did. Crossed the whole damn bridge driving around the parked cars.

I got to the agent, and she said (in Spanish) "I'm gonna talk to you in Spanish because I get the impression you understand it."

I saw something like this play out right in front of me at the border crossing coming back from Matamoros during spring break. The BP were rougher on the drunk spring breaker than the guy in the video. But it did cause all the drunk spring breakers to shape up.

The two guys in the truck were being dumbasses.  Having said that, i’ve been a sarcastic asshole to border patrol at checkpoints.  It’s just fun to show them my letters of transit from the SRE from the government of Mexico. And I speak exclusively in Spanish.  And I appear Mexican.  And I get to show them my global entry card, US passport, Texas drivers license and state department credentials. All with the most obnoxiously sounding German name they have ever seen and their entire career.  And while I have to admit, I appreciate them just doing their job watching them crumble psychologically in real time is an absolute fucking blast.  When your job is border protection, and you can’t comprehend cognitively that sometimes people with different sounding names are from other countries maybe this profession is not for you.   
But yeah, humble Breg when they read my German name and then see my credentials granted by the Mexican government and our own US state department ,  it’s pretty fucking funnystate

It’s amazing to me that we have 74mm students of the constitution in this country who only know the 1st and 2nd amendments.  And don’t even really understand those.  And they now know the 5th because their false God uses it on the reg.  If you were to ask them what articles 1-3 were about, the response would be something akin to “the army can’t move into your house to take your guns and the Bible you’ve never read.”

We pulled through the C/BP station on US70 outside of Las Cruces, NM last spring break on National Park vacay with the family.  It was 10pm and two agents visible, and not another soul in sight.

i rolled the window down rolling up, one agent just looked at my clearly Anglo family, waved us through before I stopped.  I stopped anyway, and double-checked, “we good?”

Too many far right (& far left) are going down the sovereign citizen path. Perhaps some are not full on card carrying members, but they seem to think that law enforcement has zero authority over them. In that video, the moron thought that because he has a right to remain silent, he can just drive away. 

Does he really think that you can drive/migrate to America by staying silent. Of course we all know that he wanted to be allowed to drive on because he's white.

And as far as staying silent, you can beat the rap, but you can't beat the ride.

This was my first thought as well. Younger brother is beaten down by decades of older brother’s  constant berating of others. His reward for answering the officer’s question is getting arrested. I have empathy for this guy.

I have experience in this situation. It’s one of the key reasons I moved away after college.
