September 1st: Texans, Fire Up Your VPNs, or Present Your Government-Issued ID to View Porn Online

Signed into law last month, effective September 1st.  We join Louisiana, Mississippi, Virginia, and Utah in requiring state-issued ID to look at porn online (or we pay a third-party service for "verification).

Sec. 129B.002.  PUBLICATION OF MATERIAL HARMFUL TO MINORS.

 (a)  A commercial entity that knowingly and intentionally publishes  or distributes material on an Internet website, including a social  media platform, more than one-third of which is sexual material  harmful to minors, shall use reasonable age verification methods as  described by Section 129B.003 to verify that an individual  attempting to access the material is 18 years of age or older.

 (b)  A commercial entity that performs the age verification required by Subsection (a) or a third party that performs the age verification required by Subsection (a) may not retain any

 identifying information of the individual.

 Sec. 129B.003.  REASONABLE AGE VERIFICATION METHODS.

(a)  In this section, "digital identification" means information stored on a digital network that may be accessed by a commercial entity and that serves as proof of the identity of an individual.

(b)  A commercial entity that knowingly and intentionally publishes or distributes material on an Internet website or a third party that performs age verification under this chapter shall require an individual to:

              (1)  provide digital identification; or

              (2)  comply with a commercial age verification system that verifies age using:

                    (A)  government-issued identification; or

                    (B)  a commercially reasonable method that relies  on public or private transactional data to verify the age of an  individual.

Oh, and we get these nifty exclaimers on porn sites, and the legislature made sure that they are in "14-point font or larger"

It also requires the following to be displayed in the footer of every adult website "in 14-point font or larger":

edit: VPNs will probably be needed anyways, since there's a decent chance that a lot of porn sites like PornHub will straight up block the entire state rather than deal with this shit, as they've blocked other states.  Then again, Texas is a huge market, so who knows.

I was wondering about Twitter, if it's still around in September?   But reading the statute, I guess it will depend if they cross that 1/3 threshold.  Reddit probably has the means to do the math to figure out the pron ratio.  Twitter probably fired the person who does the math.

When I was 12 in 1989, I learned about sex from Playboy or Hustler.  Maybe I caught Hardbodies on TV.  Maybe I got really lucky and got the see the pizza guy fuck some hot chick on VHS.

Nowadays a kid goes to pornhub and the most popular videos are all borderline incest or violence.  Usually abusing the shit out of a woman.  Its not people "trying to see boobs."  Its fucked up.   I don't think adults should be restricted from watching whatever they want to watch - and making them log in is a way of shaming them - but damn I don't want my kids learning from that shit and thinking that's normal sex.

Yeah, yeah, up to the parent to teach their kids about sex.  Whatever.  No one in history has really learned about sex from their parents.

I'm sure this isn't the answer.  I'm sure this is easily worked around.  But I wish there was an answer.

I'm not a fan of having my liberties restricted because people are afraid of sex or shitty parents. Kids are getting shot in school and dying from fentanyl ODs but God forbid they see two adults have sex.

Porn has always had age restrictions.  Even movies at your local AMC theatre have age restrictions.  Those liberties have always been restricted.

Movie ratings (PG, R, NC17) for those shown at AMC are suggested but not regulated, enforced or mandated by law

Does AMC collect and retain a copy of your ID that can then later be audited by the state? Asking because I don't see movies at AMC and have never been asked to show my ID at the theater my wife and I go to several times a month.

I don't disagree with this post.  I do think that the nature and ubiquity of modern porn has given young men some fucked up ideas about sex.  What Texas and Mississippi are doing isn't the answer....and I don't think there is an answer.
