A bit of good news.  I know, the struggle isn't over (Lee has already said he's going to try again) , but anything positive these days seems worth celebrating.

Among the dirt washed away in this so-called “Byrd bath” was a provision authored by Lee that would have put for sale up to 3.3 million acres of public land in 11 Western states, including Lee’s state of Utah. The plan received criticism from lawmakers on both sides of the aisle and from hunters, fishers, and conservation groups concerned that it would impact treasured natural sites in the American West.

And that's our bottom line.  You don't need 51% of people to be fascist-loving asshole cultists to ruin a country.  The threshold number is probably around 30%.  We're at 40%.  We are fucked, and there's no unfucking us.  They are firmly dedicated to sinking this ship, and taking all of us down with them.

30-35% +/- is baseline in most countries; it's the fact that we have a two-party system that exacerbates it (Portugal's far-right Chega party, for example, took 35% in last month's elections but they did not take power as the other two major parties locked them out; similar percentages are found in recent elections from France to Brasil). Not great, but certainly not an outlier.

On the judges thing, it might be better characterized as a suit against a Local Rule, or still more accurately, a Standing Order.

D. MD. enacted this standing order https://www.mdd.uscourts.gov/sites/mdd/files/Amended 2025-01.pdf 

That says for detainees seeking habeas corpus, certain rules apply to insure proper names are used, and to give enough time to deal with it on an emergency basis, deportations of habeas petitioners are stayed for two days.  Two.  Fucking.  Days.

Such orders come from the Chief Judge of the District, usually with the advice of the other judges.  The first authority to undo such a rule would be the Chief Judge of the Circuit sitting over the district, the Fourth Circuit.  Then I suppose the Supreme Court, which retains authority over all federal court rules.

The government is also asking that all judges of D. MD. ostensibly party to this rule or order be recused from such cases in the future, based apparently on the bias this reflects.  Judges get to run their courtrooms.  When a set of circumstances, like an administration hot to trot to deport people in a hurry, starts infringing on courtroom order and procedure, judges get to set some rules.

I suspect this goes nowhere.  Totally embarrassing for the US DOJ.  Fucking clown show.
