Weird, because I'm pretty sure any layperson thinks that is unbecoming behavior even if it was a Halloween costume and joke and not real life.

If they are basing his termination on the "unbecoming" portion and not the charged with a felony portion, it is definitely going to court, which is my point.  I think Beard has enough to at least get a trial, including discovery, which I imagine both sides would prefer to avoid.

I was extremely confident that Texas would win a National Championship under Beard. This has been a continuous kick in the balls for the past 3 weeks. Fuck Beard for not being able to control himself and keep his hands off his woman. CDC has shown the ability to make awesome hires and Texas is a fantastic job, we will get our guy eventually.

I kind of find it humorous that UT gave him a couple of hours to think about resigning...knowing full well there was no way in hell he would (if he resigns, there is no suing UT later for not paying him).

It's almost as if the UT attorneys were bored with the lack of competition on the other side of the table and decided to have some fun with it.  "Hey, let's offer him the chance to resign....bwahahahahaha".

I believe the Texas Legislature must waive SI.  I don't know if they did that here, but I doubt it.  My understanding on getting around SI is to get a non-State of Texas entity to guaranty the agreement.  Many alums would happily do that to get a big name coach.

That's the difference.

 

Edit to add:  I'm not defending it.  There shouldn't be separate rules in incidents of domestic violence.  I'm just stating why he wasn't fired and Beard was.

If UT is going to stay out of court, they are going to have to prove they win even assuming the facts are as Beard alleges.  So assuming that he alleges that he is totally innocent and never did anything physical, then what is the conduct unbecoming?  Being falsely accused of a crime and then being falsely imprisoned for that crime?

 

Obviously that is probably not what happened, but if UT is going to avoid a trial altogether, it's difficult to do on a loose standard like "conduct unbecoming."

Well, unless the State of Texas effectively waived SI, it can.  I suspect some very rich ATM alums happily backstopped the contract.  They (unwisely) thought they had a national championship locked up.

You have a very clear misunderstanding of what's going on here. His innocence or guilt is immaterial. Getting arrested is more than enough cause for UT to fire him. Full stop, end of story.

Even if they legally can, I doubt they would.  A&M got Jimbo because they were willing to offer more guaranteed years.  If coaches know those guarantees are not worth anything, it will be difficult to get the same level of coach.

 

It doesn't matter as much for Tech, because Tech is generally not looking to hire that quality of coach, so the guarantee matters less.
